Terms of Service

App: Portia
Last updated: 1 November 2026

1. Acceptance of these terms

These Terms of Service ("Terms") are an agreement between you and Shatrudra Pratap Singh ("we", "us", "our") for your use of the Portia mobile app and its related servers (the "Service"). By creating an account or using the Service you agree to these Terms and to our Privacy Policy at https://portia-legal.vercel.app/privacy-policy. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 13 years old. If you are under 18 (or the age of majority where you live), you may use the Service only with the permission of a parent or guardian, who is responsible for your use. You must be able to form a binding agreement under the law that applies to you and must not be barred from using the Service by any law.

3. Your account and sign-in

4. What the Service does, and its limits

Portia offers English practice: a level assessment, learning plans, daily practice, written and spoken conversations with an AI coach, mistake review, progress tracking, and speaking practice with recorded feedback reports.

Please understand the following:

6. Acceptable use

You agree not to:

7. Your responsibilities

You are responsible for your phone, internet connection and any data charges; for the accuracy of what you provide; for choosing a safe place to practise; and for backing up anything you want to keep outside the App. Using the microphone and camera is your choice and you can switch them off in your phone settings.

8. Intellectual property

The Service, including the App, design, text, exercises, questions, software and trademarks, belongs to us or our licensors and is protected by law. We give you a personal, revocable, non-exclusive, non-transferable licence to use the App on your own device for your own non-commercial learning, as long as you follow these Terms. Open-source components in the App are used under their own licences. You may send us feedback or suggestions; we may use them freely without obligation to you.

9. Third-party services

The Service relies on third parties such as Google, Apple, Firebase, Render, Vercel, OpenAI, and text-to-speech providers. Their own terms apply to their services, and we are not responsible for their availability or conduct. Sign in with Google or Apple is subject to Google's and Apple's terms.

10. Service availability

We try to keep the Service available but do not promise it will be uninterrupted, error-free or always secure. It may be unavailable because of maintenance, outages, provider limits or events beyond our control. We may change, suspend or stop any feature, with or without notice. If our main server is down, a backup server may offer a reduced set of features (for example without speaking practice).

11. Suspension and termination

You may stop using the Service at any time. We may suspend or terminate your access, with or without notice, if you break these Terms, create risk or legal exposure for us or others, or if we stop offering the Service. If we terminate your account without cause, we will make reasonable efforts to let you delete your data first.

12. Deleting your account

You can delete your account in the App under Account > Delete my account. Deletion permanently removes your account and the learning, practice and speaking data we hold in our live systems, as described in the Privacy Policy, and cannot be undone. If you cannot use the App, you can request deletion at https://portia-legal.vercel.app/delete-account or dharmotech90@gmail.com. Provisions that by their nature should survive deletion (such as ownership, disclaimers, limits of liability and governing law) will survive.

13. Disclaimer of warranties

To the fullest extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, and that the Service will meet your needs or achieve any learning outcome. Nothing in these Terms excludes rights you have under consumer laws that cannot be excluded.

14. Limitation of liability

To the fullest extent permitted by law, we and our directors, employees and providers are not liable for any indirect, incidental, special, consequential or punitive damages, or for loss of profits, data, opportunity or goodwill, arising from your use of or inability to use the Service, including reliance on automated feedback. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the 12 months before the claim, or INR 1,000 if you paid nothing. Some places do not allow these limits, so they may not apply to you in full.

15. Indemnity

You agree to compensate us for losses and costs arising from your breach of these Terms or your content, to the extent permitted by law.

16. Changes to these Terms

We may change these Terms. We will post the new version at https://portia-legal.vercel.app/terms with a new "Last updated" date and, for material changes, tell you in the App. If you keep using the Service after the changes take effect, you accept them. If you do not agree, stop using the Service and delete your account.

17. Governing law and disputes

These Terms are governed by the laws of India, without regard to conflict-of-law rules. Courts at Delhi, India have exclusive jurisdiction over disputes, except where mandatory consumer law in your country gives you the right to bring a claim elsewhere.

18. General

If a part of these Terms is unenforceable, the rest stays in effect. Our not enforcing a right is not a waiver. You may not transfer your rights under these Terms; we may transfer ours in a merger or sale of the business. These Terms and the Privacy Policy are the whole agreement between you and us about the Service.
